Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 13th day of
Segremher , 1988. The following members were present: ,
Mayor S_hn i de , Councilmembers Ricker, Zitur and Sisk ,
The following members were absent: Cnuncilmemher Vasiliou
CnnnrilmPmhPr Sick introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 88-577
REQUEST FOR PAYMENT NO. 5 AND FINAL
REVERE LANE/TRENTON PLACE 2ND ADDITION
PROJECT NO. 517
WHEREAS, the City of Plymouth as owner and Moser Construction Company, as
contractor, have entered into an agreement for the Revere Lane/Trenton Place
2nd Addition Improvements, City Project No. 517, said agreement being dated
November 10, 1987; and
WHEREAS, the Engineer has certified his acceptance of the work and his
approval of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $44,250.55, change
orders in the amount of $5,097.70 were approved and the
value of the work to date is $49,335.15.
2. That the work performed by the Contractor for the Revere
Lane/Trenton Place 2nd Addition Improvements Project and
certified to the Council by the engineer as acceptable,
being the same, is hereby released from the contract except
as to the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 5 and Final in the amount of
$7,760.63 to Moser Construction Co. for the Revere
Lane/Trenton Place 2nd Addition Improvements Project is
hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneider, Councilmembers Ricker, Zitur and
Sisk
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
