tPursuant to due call and notice thereof, a __special meeting of the City Council of
the City of Plymouth, Minnesota was held on the 13th day of September ,
1988. The following members were present: Mayor Schneider, Councilmembers Vasiliou ,
Zitur and Ricker
The following members were absent: Councilmember Sisk
Councilmember Zitur introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88- 574
APPROVING AGREEMENT
CHICAGO AND NORTHWESTERN TRANSPORTATION COMPANY
WHEREAS, as part of the construction of the new interchange at 1-494 and County Road h,
it is necessary to extend sanitary sewer to serve land at the southeast corner of the
new interchange; and
WHEREAS, the existing sanitary sewer lies between 13th Avenue and the existing Chicago
and Northwestern Railroad; and
WHEREAS, said sanitary sewer needs to cross the railroad right-of-way; and
WHEREAS, an agreement is necessary with the Chicago and Northwestern Transportation
Company to cross their railroad right-of-way.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the Mayor and City Clerk are hereby authorized and directed to enter
into the attached agreement with the Chicago and Northwestern Transportation Company
for the railroad crossing of said sanitary sewer.
The motion for the adoption of the foregoing Zesolution was duly seconded by
Cnnnrilmemher Rirker , and upon vote being taken thereon, the following voted

Whereupon the Resolution was declared duly passed and adopted.
