Pursuant to due call and notice thereof, a special meeting of the City Council of the
City of Plymouth, Minnesota, was held on the 13th day of September—, 1988. The
following members were present: Mayor Schneider, ounciImembers Vasiliou, Ricker
and Zitur
The following members were absent: Councilmember Sisk
Councilmember Zitur introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-551
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR ALLENS
LAKE VIEW ADDITION FOR S.K. AND J.E. ALLEN (88109)
WHEREAS, the City Council has approved the Final Plat for Allens Lake View Addition for
as requested by S.K. and J.E. Allen;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with City
Policy in effect at issuance of Building Permit but, prior to filing Final Plat
for Lot 1.
3. Payment of park dedication fees -in -lieu of -edication in accordance with City
Policy in effect at issuance of Building Permit but, prior to filing Final Plat
for Lot 2.
4. Removal of all dead or dying trees from the property at the owner's expense.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
6. No yard setback variances are granted or implied.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
8. No Building Permits to be issued for Lot 2 until the Final Plat is filed and
recorded with Hennepin County.
9. Access shall be limited to internal public roads and prohibited from County Road
101.
9. A covenant and cross easements shall be prepared, approved by the City Attorney
and filed, providing for a single curb cut access to Merrimac serving both lots.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Ricker and upon vote being taken thereon the following
