Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 13th day
of September 19_L8 The following members were present: Mayor Schneider,
Councilmembers Vasilic.,, Ricker.and Zitur
The following members were absent: Councilmember Sisk
Councilmember Zitur introduced the following Resolution and
moved its adoption:

APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR OFFICE BUILDING IN I-1 ZONE
FOR TRAMMELL CROW COMPANY BUILDING "D" SOUTHEAST OF FIRST AVENUE NORTH AND
CHESHIRE LANE (88095D)
' SAS, Tr�l Crow Ccepany has requested approval of a Site Plain and
Conditional Use Permit for a 28,500 Square Foot Office/Tech Building on a Lot
of 160,355 Square Deet (Building "D") to be located at the Southeast Quadrant
of First Avenue North and Cheshire Lane; and,
WHEREAS, the Planning Cmmdssion has reviewed said request at a duly called
Public Hearing and Aecrrds Approval:
NOW, TIMWME, BE IT MEBY RESOLVED BY THE CITY COUNCIL OF THE CITY nF
PLYNOUIH, NIN ESOM, that it should and hereby does approve the request for
Trammel Crow Conpany for a Site Plan and Conditional Use Permit for a 28,500
Square Foot Office Tech Building on a Lot of 160,355 Square Feet (Building
"D") to be located at the Southeast Quadrant of First Avenue North and
Cheshire Lane, subject to the following conditions:
1. Compliance with the City Engineer's Namranci:zn.
2. Payment of park dedication fees -an -lieu of dedication in accordance with
the Dedication Policy in effect at the time of Building Permit issuance.
3. Submission of required financial guarantee and Site Performance Agreement
for completion of site improvements.
4. Any signage shall be in compliance with the Ordinance.
5. Any subsequent phases or expansions are subject to required reviews and
approvals per ordinance provisions.
6. Compliance with the Ordinance regarding the location of fire hydrants and
fire lanes.
7. All waste and waste containers shall be stored within the structure and no
outside storage is permitted.

8. An 8-1/2 x 11 inch "As Built" Fire Protection Plan shall be submLLtted
prior to the release or reduction of any site bonds per City
Policy.
9. No Building Permit to be issued until the Final Plat is filed and recorded
with Hennepin County.
10. Covenants shall be prepared for approval by the City Attorney providing
for shared use of parking, drives and curb cuts. The Covenants shall be
filed with Mmepin County prior to issuance of the Building Fox mit.
11. Office occupancy in excess of 501 of the structure shall be permitted only
to the extent that off-street parking is to support such
occupancy cuimistent with off-street parking fMMlas of the Zoning
Ordinance. The submitted plans provide for perking up to 1001 office
occupancy as required by Ordinance. Deferral of construction of 39 of the
required spaces is approved until the City dstsnin o the constructed
parking is deficient per ordinance off-strsrat parking stmxhmrd s.
The emotion for adoption of the foregoing Resolution was duly seconded by
Councilmembei Ricker , and upon vote being taken thereon, the
following voted in favor thereof: Mayor ,Schneider, Cnuncilnaj&ers Vaailiou.

Whereupon the Resolution was declared duly passed and adopted.
