HomeMy WebLinkAboutCity Council Resolution 1988-509CITY OF MHOUTH Pursuant to due call and notice thereof, a -special meeting of the City Council of the City of Plymouth, Minnesota, was held on the ZFad day of August , 1988. The followhio members were present: Mayor Schneider, Zouncilmembersash iliou, Ricker, Zitur and Sisk e following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION N0. 88-509 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO A PLANNED UNIT DEVELOP- MENT FINAL PLAT FOR RYAN CONSTRUCTION COMPANY FOR WATERFORD PARK PLAZA (87027) (MPUD 86-1) WHEREAS, the City Council has approved the Planned Unit Development Final Plan/Plat and and Development Contract for Waterford Park Plaza as requested by Ryan Construction Company; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of issuance of Building Permit. 4. No Building Permits shall be issued until a Contract has been awarded for the con- struction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No yard setback variances are granted or implied. 8. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 9. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 10. The Final Plat mylars shall contain a statement noting that the plat is part of the approved MPUD 86-1 per Section 9 of the Zoning Ordinance. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the follow voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The followinq voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
