HomeMy WebLinkAboutCity Council Resolution 1988-446CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the day of August , 1988. The following members were present: MayorSchnei e�ounclImembers Vasillou, Ricker, Zitur and Sisk _. e following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-446 CONDITIONAL USE PERMIT AND RESIDENTT'_ PLANNED UNIT DEVELOPMENT PLAN AMENDMENT FOR HAROLD K. LEYSE (88076) (RPUD 75-2) WHEREAS, Harold K. Leyse has requested a Conditional Use Permtt and Planned Unit Development Amendment for property located at the southeast corner of 39th Avenue North and Deerwood Lan.: to allow the addition of a third parking stall to his existing two stall garage at 3820 Deerwood Lane North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Harold K. Leyse for a Conditional Use Permit and Residential Planned Unit Development Plan Amendment to allow the addition to an existing garage that requires a setback of 22.6 ft. versus the 30 ft. front yard setback requirement in this Planned Unit Development on property located at 3820 Deerwood Lane North, based on and subject to the following conditions: 1. The request meets the Conditional Use Permit criteria of the Zoning Ordinance, and the proposal would set no adverse precedent because of the unique situation of this lot with the cul-de-sac curve and wooded area of the lot. 2. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the .o ow ng voted In favor thereof: or Schneiders Councilmembers�Vasiliou .Ricker Zitur and Sisk --- -The o ow ng voted against or abstained: None - Whereupon the Resolution was declared duly passed and adopted.
