Pursuant to due call and notice thereof, a regular meeting Y of the Cit Council of the
City of Plymouth, Minnesota, was held on the 18th day of July , 1988. The
following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur
and Sisk The
following members were absent: None
Councilmember Sisk introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-415
AP--1VING APPEAL BY JEROME BEGIN OF BOARD OF ZONING ADJUSTMENTS AND APPEALS JULY 12,
1988 RULING (01-01-88)
WHEREAS, Jerome Begin, pursuant to Section 11, Subdivision C., of the Plymouth Zoning
Ordinance has appealed the July 12, 1988 ruling of the Board of Zoning Adjustments and
Appeals relative to his request for a 100 ft. variance from the minimum Shoreland
Management setback at 5590 Juneau Lane North; and,
WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter as referred
by the City Council, and a ruling was made to deny the variance requested; and,
WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjust-
ments and Appeals, as well as the petitioner's application for the variance;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the appeal by Jerome Begin of the Board
of Zoning Adjustments and Appeals ruling based on the following:
1. Ordinance Variance Criteria have been met.
2. Approval is granted for a variance for a maximum 60 ft. encroachment into
the required Shoreland Management setback.
3. The variance is granted due to the unique triangular shape of the parcel
with a creekway channel to the east side; to the need for preservation of
natural amenities; and, to the finding that the Shoreland Management
regulations were adopted after the purchase of this parcel by the property
owners.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Ricker , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and
Sisk The
following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
