Pursuant to due call and notice thereof, a �Re ular� meeting of the City Council of the
City of Plymouth, Minnesota, was held on the TSth day of O�ulx , 1988. The
following members were present: Mayor SchneiderZ ouncilmembers Ricker, Vasiliou, Sisk,
and Zitur
The following members were absent: None
Councilmember Zitur introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-408
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR WOOD
POINTE ESTATES FOR WOOD POINTE DEVELOPMENT GROUP (88044)
WHEREAS, the City Council has approved the Final Plat and Development Contract for
Wood Pointe Estates as requested by Wood Pointe Development Group;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
I. - Compliance with the City Engineer's Memorandum.
. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City
Policy in effect at the time of filing the Final Plat.
3. No Building Permits shall be issued until a Contract has been awarded for the con-
struction of municipal sewer and water.
4. Removal of all dead or dying trees from the property -at the owner's expense.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
6. No yard setback variances are granted or implied.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
8. No Building Permits to be issued until the Final Plat is filed and recorded with
Hennepin County.
9. Approval includes a Variance from the Subdivision Design Standards to permit an 8%
grade over a portion of 5th Avenue North, based on the finding that the Subdiv-
ision Code Variance Criteria have been met.

10. Lots 2 and 14 shall have private driveway easement for street access, rather than
access directly onto Sunset Trail, as shown on the staff -prepared graphic.
11. Staff is directed to Incorporate the provision for tree protection provisions in
the Final Plat and Development Contract approval, providing for payment of $50.00
per diameter - inch and for a $15,000.00 Bond, with only trees in the right-of-way
as shown on the petitioner's tree inventory approved for removal at this time;
and, trees may be removed In the area of the exact footprint of proposed homes on
Individual lots after verification and approval by staff.
12. Compliance with City Attorney's title opinion regarding proper signatories on
final plats.

Councilmember Sisk , and upon vote being taken thereon, the follow ng
