Pursuant to due call and notice thereof, a regular � meeting of the City Council of the
City of Plymouth, Minnesota, was held on the —18th day of Jul , 1988. The
following members were present: Mayor Schnel rW,—ouncilmembersas lio� u, kICker,
Zitur and Sisk
The following members were absent: None
Councilmember Sisk introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-406
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR TYRFLL
SEVENTH ADDITION FOR HANS HAGEN HOMES, INC. (88072) (RPUD 79-2)
WHEREAS, the City Council has approved the Final Plat and Development Contract for
Tyrell Seventh Addition as requested by Hans Hagen Homes, Inc.;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
I. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with City
Policy in effect at the time of filing the Final Plat.
3. No Building Permits shall be issued until a Contract has been awarded for the con-
struction of municipal sewer and water.
4. Removal of all dead or dying trees from the property at the owner's expense.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
6. No yard setback variances are granted or implied.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
S. No Building Permits tq !.t issued until the Final Plat is filed and recorded with
Hennepin County.
9. The Final Plat mylars shall contain a statement noting that the plat is part of
the approved RPUD 79-2 per Section 9 of the Zoning Ordinance.
10. The developer shall execute a performance agreement and shall provide an approp-
riate financial guarantee for the completion of the trail approved and required as
part of this (Amhurst/Tyrell) Residential Planned Unit Development, prior to any
subsequent Additions being approved for this Planned Unit Development.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, thefoilny
