HomeMy WebLinkAboutCity Council Resolution 1988-388CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the lithiay of .July , 19 88 The following members were present: Maynr St,hneidery cnjnrilmemh r�i Vasiliou, Ricker- Zittir and Sisk The following members were absent: None t.t Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-388 APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR ALTERATION OF THE FLOODWAY SECTION FOR WAYZATA SCHOOL DISTRICT 0284 FOR WILLOWMEADOWS SECOND ADDITION (88035). WHEREAS, Wayzata School District has requested approval for a Preliminary Plat; Rezoning from FRO to R-2; and, Conditional Use Permit for alteration of the floodway section for Willow Meadows Second Addition for 8 single family lots , a church site and a school site • on 27 acres located at the southwest quadrant of County Road 9 and Vicksburg Lane: and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval: NOW, THEREFORE, 'BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat; and, Conditional Use Permit for alteration of the floodway Section for Wayzata School District #284 for Willow Meadows Second Addition located at the southwest quadrant of County Road 9 and Vicksburg Lane, subject to the following conditions: I. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Provisions for a 30 ft. wide trail easement per Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed pans as to construction of the trail per City standards. 5. Payment of park dedication fees -in -lieu of dedication for the single family lots in accordance with the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. Payment for the school site may be made with the Building Permit issuance. 6. Street names shall comply with the City Street Naming System. 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 0 8. Rezoning shall be finalized with filing of the Final Plat. Resolution No. 88-388 Page 2 9. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 10. No yard setback variances are granted or implied. 11. Private drive access shall be limited to internal public road and restricted from Vicksburg Lane and County Road 9. 12. Resolutions #83-95 approving the Preliminary Plat/Plan and Conditional Use Permit for RPUD 83-1 is hereby rescinded. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, The following voted against or abstained None Whereupon the Resolution was declared duly passed and
