Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 20th day of
June , 1988. The following members were present:
Mayor Schneider. Councilmembers Vasiliona Ricker. Zitur and Risk ,
The following members were absent: None
Councilmember Sisk introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 88-365
AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE DEED
SWAN LAKE PROPERTIES
CITY PROJECT NO. 455
WHEREAS, the City of Plymouth undertook condemnation proceedings for Project
455 and obtained easements over certain land owned by Swan Lake Properties;
and
WHEREAS, during the condemnation process the descriptions were amended from
the original "Quick -Take" order to the Final certificate issued by the courts;
and
WHEREAS, it is necessary to clear a title problem as a result of these amended
legal descriptions.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the Mayor and City Clerk are authorized to execute
the attached Quit Claim Deed for the purpose of releasing the Grantor's
interest in certain easements acquired•by eminent domain pursuant to the so-
called "Quick -Take" provision of Minn. Stat. 117.042 (1984), but only to the
extent that said easements do not conform to the easements as described in the
Final Certificate.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneidev, Councilmembers Vasiliou Ricker, ,
Zitur and Sisk
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
