Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the2&jhday of June , 1988 The
following members were present: Mayor Schneider- Councilmembers Vasiliou,
Ricker. Zitur and Sisk
The following members were absent: None
Mayor Schneider introduced the following Resolution and moved its adoption:
RESOLUTION NO. 88-343
DENYING VARIANCES, SITE PLAN APPROVAL, AND CONDITIONAL USE PERMIT FOR IHOR PANCHENKO
FOR SUPER 8 MOTEL (88017)
WHEREAS, Ihor Panchenko has requested approval of a Site Plan, Conditional Use
Permit, and Variances for the construction of a Super 8 Motel at the northeast
corner of Highway 55 and I-494; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing;
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does deny the request by Ihor Panchenko for
Variance, Site Plan approval, and a Conditional Use Permit for the construction of a
60 unit Super 8 Motel to be located at the northeast corner of Highway 55 and I-494
based on the following findings:
1. The Conditional Use does not conform to the applicable regulations of the
Zoning District in that it requires Variances from the Zoning Ordinance
minimum standards.
2. The yard setback Variances are not warranted for the following reasons:
A. The particular physical surroundings and shape of the parcel do not
result in a particular hardship versus an inconvenience. The Site can
be designed to contain a motel use without the Zoning Variance and the
applicant has indicated that this is possible.
B. The purpose of the variation is based upon a desire to increase the
value or income potential of the parcel since a more appropriate
design without variances could result in fewer units or a more costly
structure.
C. The granting of the Zoning Variances could be detrimental to the other
land and improvement in the area and in areas at the interchange of
highways. Abutment to a diamond or other interchange is not the basis
for a setback Variance, especially for new construction.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Sisk , and upon vote being taken thereon, the
following voted in favor thereof: _ Mayor Schneider, Councilmembers Zitur and Sisk
The
following voted against or abstained Councilmembers Vasiliou-and Ricker Whereupon
the Resolution was declared duly passed and adopted.
