Pursuant to due call and notice thereof, a re��lar meeting of the City Council of the
City of Plymouth, Minnesota, was held on the 20th day of June, 1988. The
following members were present: Mayor Schneler,Z`ouncilmembers as ou, Rimer,
Zitur and Sisk
were absent:
Councilmember Ricker introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-342
APPROVING PRELIMINARY PLAT AND VARIANCE FOR WOOD POINTE DEVELOPMENT GROUP FOR WOOD
POINTE ESTATES (88044)
WHEREAS, Wood Pointe Development Group has requested approval for a Preliminary Plat
and Variance for Wood Pointe Estates, a plat for 14 single family residential lots on
9.25 acres located north and west of the intersection of Sunset Trail and Balsam Lane;
and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the Preliminary Plat and Variance for
Wood Pointe Development Group for Wood Pointe Estates for 14 single family residential
lots located north and west of the intersection of Sunset Trail and Balsam Lane,
subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No Building Permits shall be issued until a Contract has been awarded for sewer
and water.
4. Payment of park dedication tees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of filing the Final Plat.
5. Street names shall comply with the City Street Naming System.
6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
7. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
8. Approval includes a Variance from the Subdivision Design Standards to permit an 8%
grade over a portion of 5th Avenue North, based on the finding that the Sub-
division Code Variance Criteria have been met.

9. Lots 2 and 14 shall have private driveway easement for street access, rather than
access directly onto Sunset Trail, as shown on the staff -prepared graphic.
10. Staff is directed to incorporate the provision for tree protection provisions in
the Final Plat and Development Contract approval, providing for payment of $50.00
per diameter - inch and for a $15,000.00 Bond, with only trees in the right-of-way
as shown on the petitioner's tree inventory approved for removal at this time;
and, trees may be removed in the area of the exact footprint of proposed homes on
Individual lots after verification and approval by staff.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the follow ng
Resolution was declared duly
