HomeMy WebLinkAboutCity Council Resolution 1988-3390 CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 20th day of June , 19_88 The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION NO. 88- 339 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT/CONCEPT PLAN/PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR EDWARD JOHNSTON FOR DEERW00D TRAILS DEVELOPMENT (88016) WHEREAS, Edward Johnston has requested approval for a Residential Planned Unit Development Concept Plan, and waiver of size Preliminary Plan/Plat and Conditional Use Permit and waiver of density calculation standards for Deerwood Trails for 22 single family lots on 9.45 acres located east of Schmidt Lake at 48th Avenue North. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, dINNESOTA, that it should and hereby does approve the Residential Planned Unit evelopment , Concept Plan, Preliminary Plan/Plat and Conditional Use Permit, and > related waivers of size and density standards for Edward Johnston for Deerwood Trails located at the east shore of Schmidt Lake at 48th Avenue North, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and according to the Dedication Policy in effect at the time of the the Final Plat with Hennepin County. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Rezoning shall be finalized with filing of the Final Plat. Page 2 Resolution No. 88- 339 Edward T. Johnston, Deerwood Trails Development 8. Waiver of the 40 acres Planned Unit Development size standard is approved based on compatibility with surrounding development as Planned Unit Development; this includes waiver of density calculation standards considering the site area and its in -fill status, the developer has previously dedicated the trail easement, and the developer allowed the cul-de-sac on 48th Avenue North to be constructed on the property. 9. Evidence of approval of the preliminary plat/plan by the Commissioner of Natural Resources shall be submitted prior to submittal of the final plat/plan, and prior to any site grading. 10. A plan shall be submitted for review and approval by staff showing the mitigative measures that will be taken to minimize tree loss, particulary in the southwest area, prior to any site grading.
