HomeMy WebLinkAboutCity Council Resolution 1988-313CITY 'OF ' PLYMOUTH Pursuant to due call and notice thereof, a __.regular meeting of the City Council of the City of -Plymouth, Minngsota, was held on the 6th day of June , 19.__$,8._ The following members were present: Dcputy MayQr Sisk Councilmembers Vasiliou, Riskar and Zitur The following members were absent: Mayor Schneider _Councilmember Zasur introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-313 APPROVING A CONDIT19NAL USE PERMIT FOR LITTLE CAESARS PIZZA OF MINNESOTA, INC. TO OPERATE A CLASS II RESTAURANT AT THE OAKWOOD SHOPPING CENTER, 1400 HIGHWAY 101. (88047) WHEREAS, Little Caesars Pizza of Minnesota, Inc., has requested a Conditional Use Permit to operate a Class 11 Restaurant at the Oakwood Shopping Center, located at 1400 Highway 101; and, WHEREAS, the Planning Commission ha.s reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOA, MINNESOTA, that it should and hereby does approve the request for Little Caesars Pizza of Minnesota, Inc., for a Conditional Use Permit to operate a Class II Restaurant at the Oakwood. Shopping Center at 1400 Highway 101, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation.thereof shall be grounds for revocation. 2. The permit is issued to Little Caesars Pizza of}Minnesota, Inc. as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored within approved designated areas. 5. There shall be no outside display, sales, or storage of merchandise or related materials. 6. The permit shall be reviewed in one year to assure compliance with the conditions. 7. Compliance' with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance. 8, 'Compliance with Conditions #11 and #12 of City Council Resolution a87-188 with regard to owner installation of landscaping and fencing prior to issuance of an Occupancy Permi.t for this use. 9. No independent signage is hereby approved. All signage shall be responsive to the "Comprehensive Sign Plan" for the Oakwood Shopping Center. The motion for adoption of the foregoing Resolution was duly seconded by ,Councilmember R, k r and upon vote being taken thereon, the following voted in favor thereof: . Deputy Mayor Sisk, Councilmembers Vasiliou, Rieker and Zi ,r The following voted against or abstained: None Nhereupon. the Resolution was declared duly passed and adopted.
