The following members were present: Deputy Mayor Sisk..„.Cornci memb. sya iliou, Ricker and Zitur The following members were absent: Mayor Schneider Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 88- 311 APPROVING SITE 'PLAN, VARIANCES AND CONDITIONAL USE PERMIT TO ALTER THE FLOODWAY OVERLAY DISTRICT FOR THE METROPOLITAN WASTE CONTROL COMMISSION FOR A PLYMOUTH LIFT STATION. (88033) WHEREAS, The Metropolitan Waste Control Commission has requested approval for a Site Plan and Conditional Use Permit for the Plymouth Lift Station. WHEREAS, The Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY .COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA,_ that it should and hereby does approve the Site Plan, Variances and Conditional Use Permit to alter the Floodway Overlay District for The Metropolitan Waste Control Commission for the Plymouth Lift Station located at 9900 State Highway 55, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all deac or dying trees from the property at the owner's expense. 3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 4. No Building Permits shall be issued until the effective date of the "Quick Take" Order, or until Title has been acquired, which ever is first, and a written commitment is received from the Metropolitan Waste Control Commission that it will process and record the Final Plat. 5. Approval of variance to Section 10, Subdivision C, 9 of the Zoning Ordinance to allow two principal buildings on one lot. 6. Approval of variances' to the Zoning Ordinance to allow 29 foot front yard setback, (50 feet required) and rear yard setback of 23 feet (25 feet required) and setbacks from structures to drives of 5 feet and 9 feet (10 feet required). 7. Submittal of ordinance required Site Improvement Performance Agreement and financial guarantee prior to issuance of Bulding Permits. The motion for adoption -of the foregoing Resolution was duly seconded by Deputy Mayor Sisk , and upon vote being taken thereon, the following voted in favor thereof: Deput) Mayor Sisk Councilmembers The following voted against'or abstained: Nnn,- iscer , 1 r Whereupon the Resolution was declared duly passed and adopted.
