None Councilmember Vasiliou introduced the following Resolution and moved Its adoption: RESOLUTION NO. 88-282 DENYING A CONDITIONAL USE PERMIT AMENDMENT FOR RANDALL MORD TO ALLOW A REDUCED SIDE YARD SETBACK WITHIN THE KINGSVIEW HEIGHTS RESIDENTIAL PLANNED UNIT DEVELOPMENT (88031) WHEREAS, Randall Nord, has requested a Conditional Use Permit Amendment to allow for a reduced side yard setback (8 ft. versus 10 ft) on property located at 4420 Harbor Lane North in the Kingsview Heights 2nd Addition (RPUD 85-1); and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends denial; NOW$ THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby denies the request by Randall Nord for a Conditional Use Permit Amendment to allow for a reduced side yard setback (8 ft. versus 10 ft.) for property located at 4420 Harbor Lane North in the Kingsview Heights 2nd Addition, based on the following: 1. It has not been demonstrated that there is a uniqueness or hardship to warrant the reduced setback for this property. The proposed setback is not appropriate for the Planned Unit Development as a whole. 2. Alternate designs would allow compliance with the minimum setbacks required in the Kingsview Heights Residential Planned Unit Development. 3. The proposal is not consistent with the character of the Planned Unit Development. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the follow ng voted n favor t ereo t or Schnelder, Councilmembers Vasiliou Ricker Zitur and Sisk The o ow ng voted against or abstained:- None Whereupon the Resolution was declared duly passed and adopted'.
