The fo.lowing members were present: , U- nr Sr.hneidari Cnuncilciliou_ Ricker- Zitur and Sisk The following debars were absent: None A a it art** Cnunr•ilI or Sick introduced the following Resolution and moved its adoption: RESOLUTION NO- 88- 239 RLQUEST FOR PAYMENT NO. 4 AND FINAL GLEASON LAKE DRIVE - TRAIL IMPROVEMENTS PROJECT NO. 602 WHEREAS, the City of Plymouth as owner and Preferred Paving, Inc. as contractor, have entered into an agreement for the Gleason Lake Drive Trail Improvements, City Project No. 602, said agreement being :iated November 5, 1986; and WHEREAS, the Engineer, Short, Elliott, Hendrickson, Inc., has certified his acceptance of the work and his approval of the final request for payment; and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $147,154.10 and the value of'the work to date is $159,165.60. 2. That the work performed by the Contractor for the Gleason Lake Drive - Trail Improvement project and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except a■ to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 4 and Final in the amount of $10,096.54 to Preferred Paving, Inc. for the Gleason Lake Drive - Trail Improvements is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by f-euncil shE.r Zi ur , and upon vote being taken thereon, the following voted in favor thereof: _ayor Schneider- Councijmembers Vasiliou. Ricker , 7itnr and Siek The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
