HomeMy WebLinkAboutCity Council Resolution 1988-188CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 21st day of March, 1988. The following members were present: Mayor Schneider �ounclimembers Vasil ou Ricker Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-188 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN, PRELIMINARY PLAN/PLAT, FINAL PLAN AND CONDITIONAL USE PERMIT FOR MARK RAVICH, VICKSBURG APARTMENT COMPANY (RPUD 88-01) (87131) WHEREAS, Mark Ravich, Vicksburg Apartment Company has requested approval for Rezoning, Residential Planned Unit Development Concept Plan, Preliminary Plan/Plat, Final Plan/ Plat and Conditional Use Permit for approximately 16.7 acres for one lot to include 334 apartment units northeast of Vicksburg Lane and New County Road 9; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Residential Planned Unit Development Concept Plan, Preliminary Plan/Plat, Final Plan, and Conditional Use Permit for Mark Ravich, Vicksburg Apartment Company, for Vicksburg Addition located northeast of Vicks- burg Lane and New County Road 9, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Payment of park dedication Pees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of at issuance of Building Permit. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements; the agreement shall assure that all private recreational amenities on the site shall be completed according to the approved plan and that an "As -Built" survey showing those amenities shall be filed with the City. 7. Any signage shall be in compliance with the Ordinance. PLEASE SEE PAGE TWO Page two Resolution No. 88-188 8. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 9. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 10. All waste and waste containers shall be stored within the structure and no outside storage is permitted. 11. Rezoning shall be finalized with filing of the Final Plat. 12. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 13. No yard setback variances are granted or implied. 14. Final Plat mylars shall refer to RPUD No. 88-01. 15. An 8 1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvements financial guarantees per City Policy. 16. Appropriate legal documents, setting forth the property ownership's responsibility to share in the costs of providing traffic signal indicator lamps and the necess- ary supports facing the private driveway shall be approved by the City Attorney and filed with the Final Plat. 17. Appropriate Condominium documents shall be prepared in the event the buildings would become owner -occupied; and, shall be approved by the City Attorney to be consistent with City requirements and regulations. 18. Financial guarantees shall be prepared to assure that the building and site amenities shall be completed according to the approved plans submitted by the developer; and, that an "As -built" survey showing those amenities be filed with the City. 19. Additional buffering shall be provided between Building 2 and the neighborhood to the north to minimize noise impact from the tennis courts and pool by adding 19 trees of the same species as those shown on the revised plans. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the following voted In favor thereof: Mayor Schneider, Councilmembers Vasillou, Ricker, Zitur and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
