The following members were present: Mayor Schneicerouncilmembers as ou Ricker Zitur and Sisk The following ers were Ment: None Councilmember Ricker introduced the following Resolution and moved its a pt on: RESOLUTION NO. 88-184 APPROVING MODIFICATION OF MINIMUM FRONT YARD SETBACK FOR LOT 2 BLOCK 2, DEERWOOD GLEN PLAT TWO (RPUD 85-4) (87010) WHEREAS, Wayne Fleck, Novak -Fleck, Inc., has requested a modification of the minimum front yard setback for Lot 2, Block 2, Deerwood Glen Plat Two, from 35 ft. to 30.5 ft., for a single family detached dwelling; and, WHEREAS, A building permit was issued on February 10, 1988, based upon a plot plan showing a minimum front yard setback of 30.5 ft.; and, WHEREAS, the permit indicated the approved minimum setback of 35 ft., but the dimension on the plot plan was not corrected during the plan review process; and, WHEREAS, the plot plan, approved Planned Unit Development Plan, and construction in the field have been carefully reviewed with respect to the impact of the proposed setbacks; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request of Wayne Fleck for a PUD Plan modification for the front yard setback for Lot 2, Block 2, Deerwood Glen Plat Two from 35 ft. to 30.5 ft. based upon the following findings: The modification as requested for this property and for this single family detached dwelling does not have a detrimental impact upon this property or upon the Planned Unit Development; the modification, while prompted by an error, is deemed reasonable as a matter of Planned Unit Development design flexibility. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the follow ng voted In favor thereof: Mayor Schneider, Councilmembers Vasiliou Ricker Zitur and Sisk The o ow ng voted against or abstained: None Whereupon the Resolution was declared duly passed an adopted.
