The following members were present: Mayor Schne e� r �ouncilmem ers as ou Ric eer Zitur and Sisk he following ers were absent: None *tet *** *** Counclimember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-183 APPROVING REVISED MIXED PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR DAVID PETERSON, HEW LYN, INC./FGC CORPORATION FOR "HARRISON HILLS PONDS" (87109) (lPUD 88-02) WHEREAS, David Peterson, New Lyn, Inc./FGC Corporation has requested approval for a Revised Mixed Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for 93 single family lots, ten units for attached twinhomes, 42 units for attached townhomes, 272 units for attached multi -family housing (apartments or condominiums), and 25 gross acres for neighborhood shopping on a 96 acre site located southwest of County Road 10 and Nathan Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Revised Mixed Planned Unit Develop- ment Preliminary Plan/Plat and Conditional Use Permit for 'David Peterson, Hew Lyn, Inc./FGC Corporation for Harrison Hills Ponds located southwest of County Road 10 and Nathan Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount to be determined according to verified acreage according to the Dedica- tion Policy in effect at the time of filing the Final Plat with Hennepin County. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Rezoning shall be finalized with filing of the Final Plat. PLEASE SEE PAGE TWO Page two . Resolution No. 88-183 8. Completion of required Environmental Assessment Worksheet in accordance with the Environmental Quality Board (EQB) regulations prior to submittal of the Final Plat application. 9. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 10. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions as approved by the City Attorney shall be filed with the Final Plat. 11. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 12. The maximum number of bonus points allowed for this development is +5 for 417 total dwelling units, for the land above the 100 -Year High Water Mark, as verified by the City Engineer. 13. A private trail system to be constructed within the project providing residents of the PUD with Internal access. 14. No permanent private drive access shall be permitted to County Road 10; all private drives shall be from internal public streets. 15. A sign with a map showing all approved lots and public and private open space and amenities shall be displayed at all entrances to the subdivision so all prospective buyers know their location. 16. The temporary construction access shall be provided at the intersection of the new north/south street and County Road 10 for all construction vehicles until the first house is certified for ocr•:-)ancy. This is to include positive blocking of 55th and 56th Avenues with a fence. 17. 56th Avenue North must be extended to the east boundary of this site, i.e., to Nathan Lane, prior to the start of Phases III and IV, 18. Additional berming shall be installed southwest of Block 11, to enhance the transition. 19. A copy of the March 9, 1988 Planning Commission Minutes, reflecting discussion on this item, shall be provided with the Final Plan when presented to the Planning Commission.
