HomeMy WebLinkAboutCity Council Resolution 1988-182CITY OF PLYMOUTH • Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 21st day of March , 1988. The following members were present: Ma or Schne der ouncilmembers Vasillou, Ric eir Zitur and Sisk The following me ers were absent: None Counclimember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-182 APPROVING REVISED MIXED PLANNED UNIT DEVELOPMENT (MPUD) CONCEPT PLAN FOR DAVID PETERSON, HEW LYN, IMC./FGC CORPORATION (87109) WHEREAS, David Peterson, Hew Lyn, Inc./FGC Corporation, has requested approval of a Revised Mixed Planned Unit Development Concept Plan for the development of single family detached, twin homes and townhomes, multi -family (apartments or condominiums), and approximately 25 acres for neighborhood shopping, on a 96 acre site located south- west of County Road 10 and Nathan Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Informational Hearing and has recommended approval; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Revised Mixed Planned Unit Develop- ment Concept Plan for David Peterson, Hew Lyn, Inc./FGC Corporation, for a development to be known as "Harrison Hills Ponds" consisting of single family detached, twin homes and townhomes, multi -family (apartments or condominiums) and neighborhood shopping area on approximately 96 acres located southwest of County Road 10 and Nathan Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 3. Maximum density shall be 6.4 units per acre for the land at or above the established high water elevation per the adopted City Storm Water Drainage Plan as verified by the City Engineer. A total of 5 density bonus points are assigned as follows: a) Project size +3 b) Variety of Housing +1 c) Private Open Space +1 4. Draft restrictive covenants and related Homeowner Association Documents for the private open areas and amenities, shall be submitted with final plat/plan application; they shall be reviewed by the City Attorney prior to City Council action. PLEASE SEE PAGE TWO Page two Resolution No. 88-182 5. A private trail system to be constructed within the project providing residents of the PUD with internal access. All trails shall be per City standards; reference to wood chip trails shall be stricken from the approved plans. Trail construction shall begin prior to issuance of Building Permits for houses abutting the trails, and trails will be completed prior to issuance of Certificates of Occupancy for the houses abutting the trails. 6. No private drive access shall be permitted to County Road 10; all private drives shall be provided by internal public streets. 7. A sign with a wap showing all approved lots and public and private open space, trails, and amenities shall be displayed at all entrances to the subdivision so all prospective buyers know their location. 8. Temporary construction access shall be provided at the intersection of the new north/south street and County Road 10 for all construction vehicles until the first house is certified for occupancy. This is to include positive blocking of 55th and 56th Avenues with a fence. 9. 56th Avenue North must be extended to the east boundary of this site, i.e., to Nathan Lane, prior to the start of Phases III and IV. 10. Slopes and trees along the Bass Creek Conservation area are not to be disturbed by construction except where necessary to install sewer and water; and that necessity is to be reviewed and approved by the City Engineer. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the following Zitur and Sisk TRe fol0 voted against or abstained: None Whereupon Resolution was declared duly passed and adopted. the
