Pursuant to due call and notice thereof, a regular meeting of the City Council of the
City of Plymouth, Minnesota, was held on the 21st day of March , 1988. The
following members were present: Mayor Schne e� r Councilmembers Vasil ou Ricker
Zitur and Sisk The
following members were absent: Hone
Councilmember Vasiliou introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-176
DENIAL OF APPEAL BY EARL HANKE OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING
WHEREAS, Earl Hanke, pursuant to Section 11, Subdivision C of the Plymouth Zoning
Ordinance, has appealed the February 9, 1988 ruling of the Board of Zoning Adjustments
and Appeals relative to his request for a Variance from the minimum front yard setback
at 1171028th Avenue North; and,
WHEREAS, the Board of Zoning Adjustments and.Appeals considered the matter and a ruling
was made to deny the Variance request; and,
WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning
Adjustments and Appeals, as well as the petitioner's application.for the Variance;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does deny the appeal by Earl Hanke of the Board of
Zoning Adjustments and Appeals ruling for the following. reasons:
1. Granting the appeal would establish an undesirable precedent in the City.
2. Standards for a Variance have not been met.
3. The garage could be constructed within the Ordinance required setbacks.
The motion for adoption of the foregoing Resolution was -duly seconded by
Councilmember Ricker , and upon vote being taker, thereon, the following
