Pursuant to due call and notice thereof, a regular meeting of the City Council of the
City of Plymouth, Minnesota, was held on th� day of _ March , 1988. The
following members were present: Ma or Schneer —Councilmen ers Vasiliou. Reker,
Zitur and Sisk The
following members were absent: None
Couneilmember Sisk introduced the following Resolution and moved its
adopt on:
RESOLUTION NO. 88-162
AMENDING CONDITION TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR MIDWEST
BRICK FOR MIDWEST BRICK AND SUPPLY COMPANY (87064)
WHEREAS, the City Council has approved the Final Plat for Midwest Brick for Midwest
Brick and Supply Company; and,
WHEREAS, the Council adopted Resolution No. 88=08 which set conditions to be met prior
to the filing of said plat; and,
WHEREAS, that Resolution established condition for the payment of park dedication fee
for Lot 1 which has been determined to not be consistent with the existing Park
Dedication Policy;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, HIM-
NESOTA, that it should and hereby does approve the following to be met prior to
recording of and related to said Plat:
I. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication for Lot 2 in accordance with
City Policy in effect.at the time of issuance of a Building Permit.
3. Removal of all dead or dying trees from the property at the owner's expense.
4. No yard setback variances are granted or implied.
5. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
6. No Building Permits to be issued until the Final Plat is filed and recorded with
Hennepin County.
FURTHER, Resolution No. 88-08 is hereby rescinded.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur ., and upon vote being taken thereon, the followrnj
