HomeMy WebLinkAboutCity Council Resolution 1988-079CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the fst day of Februar , 1988. The following members were present: Mayo Schne er ouncilme ers as , Ricer, Zttur and Sisk e following me rs were absent: None Councilmember Sisk introduced the following Resolution and moved its aopt on: RESOLUTION NO. 88-79 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PUD PLAN/PLAT FOR "MALLARD POINTE" FOR NORTHLAND LAND COMPANY (87110) (MPUD 83-1) WHEREAS, the City Council has approved the Final PUD Plat and Development Contract for "Mallard Pointe" as requested by Northland Land Company; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. No Building Permits shall be issued until a Contract has been awarded for the con- struction of municipal sewer and water. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures In subdivisions adjacent to, or containing any open storm water drainage facility. 5. Yard setbacks, off-street parking, and drive ais?P/driveway widths shall be per the approved Final Plans. 6. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 7. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 8. Appropriate legal documents regarding ownership and maintenance of common aras, such as Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 9. The Final Plat mylars shall contain a statement noting that the plat is part of the approved MPUD 83-1 per Section 9 of the Zoning Ordinance. Page two Resolution No. 88-79 , 10. The developer will provide copies of the approved overall PUD Plan and Its conditions as an addendum to their purchase agreements. 11. Development shall comply with the Environmental Impact Statement approved for this development. The motion for adoption of the foregoing Resolution was duly seconded by Counclimember Zitur , and upon vote being taken thereon, the followTnq voted In favor thereof: Mayor Schneider, Councilmembers.Vasiliou, Ricker; Zitur and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed end aaopte
