The following members were present: Mayor Schneiderncil:se■bers Vastilou wicker,, Zitur, and Sisk The following me ers were absent: *** +►rr +rrw Councilmember Sisk introduced the following Resolution and moved Its adoption: RESOLUTION N0.188-77 APPROVING REVISED PRELIMINARY PLAN, FINAL PLAN, AND CONDITIONAL USE PERMIT FOR THOMAS BISANZ, NORTHLAND LAND COMPANY, FOR MALLARD POINTE (87110) (MPUD 83-1) WHEREAS, Northland Land Company has requested approval of a Revised Preliminary Plan, Final Plan, and Conditional Use Permit for 248 multi -family dwelling units on approxi- mately 15.86 acres within the Parkers Lake North MPUD to be located on the northwest corner of Niagara Lane and 18th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Northland Land Company for a Revised Preliminary Plan, Final Plan and Conditional Use Permit for 248 multi- family dwelling units on approximately 15.86 acres within the Parkers Lake North MPUD to be located on the northwest corner of Niagara Lane and 18th Avenue North, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Compliance with Policy Resolution No. 79-80 regarding ■lnlm floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 3. Submission of required financial guarantee and Site Performance Agreement for completion of site Improvements. 4. Signage shall comply with the approved PUD Sign Plan. S. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. All waste and waste containers shall be stored within the buildings and no outside storage is permitted. 7. An 8 1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site Improvement bonds per City Policy. PLEASE SEE PACE TWO Page two Resolution No. 88-77 8. No Building Permit to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Appropriate legal documents for the shared drive aisle will be filed prior to the issuance of building permits: 10. The density approved is consistent with the Development Contract approved under Resolution'No. 87-425, as follows: The total numerical mid points of the density In all areas must equal 1,147 units. If a final plat is developed above or below the mid point of a density range included in this preliminary plat, then the density ranges in other areas must be changed so that the density of the land platted, plus the mid point of all other areas, equals the maximum number allowed -- 1,147 units. With each application for residential plan/plat approval, the petitioner shall submit an accounting of the number of units remaining, by the area, along with the number of units that have been developed. Any reduction or increase in the number of units from the established range and maximum number of units, shall require an Amendment to the Planned Unit Development. Similarly, each final plat request shall include a status report stating the level of sani- tary sewer demand for all areas developed to date, and the balance of capacity re- maining in this PUD. 11. Vehicle parking and stopping will be effectively prohibited at the entry ways to the units, and this regulation will be enforced year-round by the on-site manage- ment staff. 12. Berming shall be installed on the north side of the open play fields and the revised plans shall be submitted to'be approved by City staff as to compliance with the City's Landscape Policy. 13. The width of the paved drive aisle, from garage door to the end of the parking spaces, shall be 54 ft., and the narrowest width of the drive aisles shall be 24 ft. throughout the development. 14. The front yard setback may be reduced an additional 5 ft. from the collector street for a minimum setback of 35 ft.; and, the setback to the north line may be reduced by 7 ft.; berming and landscaping along the north property line shall be enhanced to maximize the transition between the residential and industrial sites. 15. Appropriate legal documents, approved by the City Attorney, shall be filed acknowledging that a lighted City Community Playfield will be constructed across from the development and that activities and lighting of the playfield may impact this development. The motion for adoption of the foregoing Resolution was duly seconded by Counclimember Zitur , and upon vote being taken thereon, the following voted In favor thereof; es e following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
