HomeMy WebLinkAboutCity Council Resolution 1988-076CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of Februar , 1988. The following members were present: Mayor Schnee_r, ro_unc I I members as ou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: , RESOLUTION NO. 88-76 APPROVING SITE PLAN FOR CRAIG FREEMAN, FREEMAN'S INC. (87116) WHEREAS, Craig Freeman, Freeman's Inc., has requested approval of a Site Plan to allow the construction of a 2,192 seat theater on property located northeast of Shelard Parkway and Nathan Lane (Willow Grove Office Park Second Addition); and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Craig Freeman, Freeman;s Inc., for a Site Plan to allow the construction of a 2,192 seat theater on property located northeast of Shelard Parkway and Nathan Lane (Willow Grove Office Park Second Addition, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of Building Permit issuance. 3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 4. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 5. All signage shall be in compliance with the Ordinance. 6. Any subsequent phases or expansions are subject to required reviews and approv- als per Ordinance provisions. 7. Compliance with the Ordii,ance regarding the location of fire hydrants and fire lanes. 8. All waste and waste containers shall be stored within the enclosure, and no outside storage is permitted. An 8 1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 10. No Building Permit to be issued until the Final Plat is filed and recorded with Hennepin County. 11. Appropriate legal documents encumbering the shared parking (80 parking spaces on the shopping center site) as approved by the City Attorney will be filed with Hennepin County prior to the issuance of building permit. 12. Appropriate legal documents conveying shared drive and parking easements approved by the City Attorney shall be filed prior to the issuance of butldinq permits. 13. Written evidence must be submitted from the City of St. Louis Park that the access for this development onto Shelard Parkway be available for this and existing development, prior to the issuance of any building permits. 14. Parking configuration and amounts were determined and predicated on parkinq demands on certain days per occupancy demands of this theater. 15. Pedestrian and/or vehicular access shall be provided between those parking areas designated "B" and "C" on the approved Site Plan as approved by the City Engineer; both shall be provided if the agreement with the City of St. Louis Park Is appropriately amended. Lot "C" shall be clearly designated and signed as "Employee and Over -Flow" parking. 16. Ground cover shall be provide on the Island west of the building and that area shall be sodded versus the proposed use of gravel. 17. Exterior building lighting shall be limited to safety and entrance lightinq with no flood lights. 18. Lighting intensity of the sign and the theater marquee shall be compatible with the intensity of the lighting and signage for the shopping center. 19. The developer shall provide additional Information regarding the proposed building plana, giving more detail on exterior materials and building design for staff review. The Intent is to assure aesthetic compatibility with the area development. Architectural relief shall be added to the south and east sides of the building.
