HomeMy WebLinkAboutCity Council Resolution 1988-063CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 25th day of Januar , 1988 The following members were present: ayor ne er,ounc me ers mercer, Sisk, VasiIIOU and Zitur The following members were absent: None *x* *** TT Councilmember Zitur introduced the following Resolution and moved Its adoption: RESOLUTION NO. 88-63 RESOLUTION ESTABLISHING A PUBLIC HEARING DATE TO CONSIDER THE SUSPENSION OR REVOCATION OF AN INTOXICATING OFF -SALE LIQUOR LICENSE TO MR. KENNETH YOUNGBERG, KENNY'S LIQUORS, 12 NATHAN LANE WHEREAS, Plymouth City Code provides that an off -sale liquor license issued by the City Council may be denied, suspended or revoked by the Council for conviction of any crime or misdemeanor pertaining to a license held or applied for, subject to the provisions of Minnesota Statutes Chapter 364; and WHEREAS; Plymouth City Code Section 1005.23 provides that no license may be suspended or revoked until after a hearing is granted to the licensee; and WHEREAS, the Public Safety Department has reported that agents for the licensee have been convicted for the sale of intoxicating liquor to a minor on May 30, 1987; and WHEREAS, in accordance with the City Code, the Public Safety Department has recommended that a hearing be held to determine whether the license should be suspended or revoked; NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Plymouth, Minnesota, that it should and hereby does schedule a public hearing to consider the suspension or revocation of an off -sale liquor license to Mr. Kenneth Youngberg dbs Kenny's Liquors, 12 Nathan Lane, and further that the City Clerk is directed to forthwith notify the licensee that the hearing is scheduled for Monday, March 7, 1988 commencing at 7:30 p.m. In the City Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard; and further, that said licensee be advised of the violation which is considered to be cause for revocation or suspension of the license. FURTHER, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Off -Sale. Intoxicating Liquor License for Kenny's Liquors be approved for the period February 1, 1988 through January 31, 1989 subject to the outcome and Council's action on the public hearing scheduled for March 7, 1988. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the following vote n favorthereof: Mayor Schneider, Councilmembers Ricker, Sisk, Vasiliou and Zitur Th followIng voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
