HomeMy WebLinkAboutCity Council Resolution 1988-050CITY OF PLYIOUM Pursuant to due call and notice thereof, a Special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 25th day of January , 1988. The following members were present: Mayor Schneider, Councilmembers Vasillou, Ricker, Zitur, and Sisk The following members were absent: * *** *T Couneilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-50 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR WST ADDITION FOR KENNETH ESTER, WAGNER SPRAY TECH. (87130) WHEREAS, the City Council has approved the Final Plat for WST Addition as requested by Kenneth Ester, Wagner Spray Tech; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of issuance of Building Permit. k. Removal of all dead or dying trees from the property at the owner's expense. 5. No yard setback variances are granted or implied. 6. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 7. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 8. Access shall be limited to internal public roads and prohibited from County Road 6. 9. Legal documents must be filed with Hennepin County which place a covenant on pro- posed Outlot A to assure that the parking lot will be constructed on the north side of the existing Wagner Spray Tech building per approved plans, and Outlot A wIII oe final platted as a lot prior to any development of Outlot A; further, there shall be no occupancy or use of the building on Outlot A other than the cur- rent Wagner use, until Outlot A has been final platted and utilities are available to the site. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the following voted in favor thereof: 5 Ayes The following voted against or abstained: none Whereupon the Resolution was declared duly passe an a opte .
