HomeMy WebLinkAboutCity Council Resolution 1988-048CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 25th day of January , 1988. The following members were present: Mayor Schnei e- r, Tounclimem ers Vasillou. Ricer, Zitur and Sisk the following me ers were absent: None Counclimember Zitur introduced the following_ Resolution and moved its adoption: RESOLUTION NO. 68-48 APPROVING SITE PLAN AMENDMENT FOR KENNETH ESTER, WAGNER SPRAY TECH (87126) WHEREAS, Kenneth Ester, Wagner Spray Tech has requested approval of a Site Plan Amend- ment to relocate the parking lot at 1770 Fernbrook Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for a Site Plan Amendment for Kenneth Ester, Wagner Spray Tech, to relocate the parking lot at 1770 Fernbrook Lane, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements, prior to filing the Final Plat for the Wagner Addition. 3. My subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 4. If a grading permit has not been issued within one year of City approval of the Site Plan, approval shall be considered null and void and subject to all Site Plan approval requirements; Provided that within one year of the original City Council approval, the original petitioner may request in writing and the Zoning Official may approve extensions of not more than six months. 5. Legal documents must be filed with Hennepin County which place a covenant on pro- posed Outlot A to assure that the parking lot will be constructed on the north side of the existing Wagner Spray Tech building per approved plans, and Outlot A will be final platted as a lot prior to any development of Outlot A; further, there shall be no occupancy or use of the building on Outlot A other than the cur- rent Wagner use, until Outlot A has been final platted and utilities are available to the site. 6. A Conditional Use Permit must be obtained by March 1, 1988, to allow the outside storage of semi -trailers on the property or the semi -trailers must be removed from the property no later than March 1, 1988.
