HomeMy WebLinkAboutCity Council Resolution 1988-009CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4t _ day of January , 1988. The following members were present:- Mayor Schne er, ouncIImem ers as ou, Ric ir, Zitur and Sisk e following members were absent: None Councilmember Vasiliot, introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-09 APPROVING REVISED SITE PLAN AND CONDITIONAL USE PERMIT FOR ROBERT WORTHINGTON, OPUS CORPORATION (87119) WHEREAS, Robert Worthington, Opus Corporation has requested approval of a Revised Site Plan and Conditional Use Permit for an industrial building at a ratio of 60% office and 40% industrial uses east of Niagara Lane and north of 28th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request at a .duly called Public Hearing and recommends approval; NOW, THEREFORE,. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF.PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Robert Worthinqton, Opus Corporation for a Revised Site Plan and Conditional Use Permit for an industrial build- ing to be located east of Niagara Lane and north of 28th Avenue North, subject to the following conditions:. 1. Compliance with City Engineer's Memorandum. 2. Submission of required financial guarantee and Site Performance Agreement for completion of site Improvements. 3. Any signage shall be in compliance with the Ordinance. 4. Any subsequent phases or expansions .are subject to -required reviews and approvals per Ordinance provisions. 5. All waste and waste containers shall be stored within the enclosure. 6. An 8 112 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 7. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 8. The site shall be maintained in a sanitary manner. The Conditional Use Permit allows an occupancy mix of 60% office and 40% warehouse/distribution and shall be reviewed annually to assure compliance with the conditions. 10. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 11. Appropriate legal documents establishing a covenant on the property shall be approved by the City Attorney and filed at Hennepin County prior to issuance of a building permit, identifying that the future use of the building may require the construction of a parking ramp to satisfy Ordinance parking requirements. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the following voted In favor thereof: _Mayor Schneider, Councilmembers Vasiliou Ricker, Zitur and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
