HomeMy WebLinkAboutCity Council Resolution 1988-006Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4th day of January�, 1988. The following members were present: Mayor Schne e�Z,ouncilme erm�Gasl3lou, Ricker, Zitur and Sisk e following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-06 APPROVING REVISED SITE PLAN, AMENDED CONDITIONAL USE PERMIT AND VARIANCE FOR MIDWEST .,RICK AND SUPPLY COMPANY, GREENLAND INVESTMENTS (87118) WHEREAS, Midwest Brick and Supply Company, Greenland Investments has requested approval of a Revised Site Plan, Amended Conditional Use Permit, and Variances for the use and new occupancy of an existing 97,000 sq. ft. office/warehouse/manufacturing building with a maximum of four tenants in the remainder of the building at 5205 County Road 18; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval, except for one Variance; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Midwest Brick and Supply Company, Greenland Investments for a Revised Site Plan, Amended Conditional Use Permit and Variance for the use and new occupancy of an existing 97,000 sq. ft. building at 5205 County Road 18, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 3. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 4. All waste and waste containers shall be store within an enclosure that meets City standards. 5. An 8 1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reuction of any site improvement bonds per City Policy. 6. A variance is approved to allow the drive aisle between the stacked pallets to be gravel -based and used for one year, at which time, the City will inspect the site prior to the renewal of the Conditional Use Permit, to determine whether the variance should be continued on a permanent basis. 7. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. PLEASE SEE PAGE TWO Page two Resolution No. 88-06 8. The permit is issued to Midwest Brick and Supply Company as operator of the facil- ity and shall not be transferable. 9. The site shall be maintained in a sanitary manner. 10. The Conditional Use Permit shall be renewed in one year to assure compliance with the conditions. 11. Compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance. 12. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 13. One of the two free-standing signs will be removed to meet the Ordinance requirements, and wall signage will comply with Ordinance standards. All signage shall be in compliance with the Ordinance. 14. Resolution No. 87-516, adopted on August 3, 1987, is hereby rescinded.
