HomeMy WebLinkAboutCity Council Resolution 1988-004CITY OF PLVNDUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on th day of Januaarr K 1988. The following members were present: Ma or Schnei-97, Zoounclimembers Vaasi7lou, Ricer, litur and Sisk The dna members were absent: None Counci'.member Sisk introduced the following Resolution and moved its ado -p -715n: : RESOLUTION NO. 88-04 APPROVING, REVISED PLANNED UNIT DEVELOPMENT PRELIMINARY PLAT, SITE PLAN, AND VARIANCE FOR KENNETH STREETER, STREETER IWILSTMENT (87068) (MPUD 78-2) WHEREAS, Kenneth Streeter, Stre::ter Investment, has requested approval for a Revised Planned Unit Development Preliminary Plat, Site Plan, and Variance for 19,450 sq. ft. shopping facility on property located south of 34th Avenue North and Plymouth Boulevard; and, WHEREAS, THE City Council reviewed plans for this site on August 24, 1987, and directed changes to be --viewed by the Planning Commission; and, WHEREAS, the Planning Commission has reviewed the request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Revised Planned Unit Development Preliminary Plat, Site Plan, and Variance for Kenneth Streeter, Streeter Investment for "Plymouth Hills Shops" located south of 34th Avenue North and Plymouth Boulevard, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the o,ierls expense. 3. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 4. Payment of park dedication tees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of Building Permit issuance. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainaqe facility. 6. Submission of required financial guarantee and Site Performance Agreement for completion of site Improvements. 7. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. PLEASE SEE PAGE TWO Page two Resolution No. 88-04 8. An 8 1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 9. The proposal in the amended Planned Unit Development Plan (Resolution No. 87-333) to include the autoservice center gasoline dispensers on this site is reaffirmed and approved as conditional uses on this site. 10. A Registered Property Report shall be submitted and reviewed by the City Attorney prior to the Final Plat being approved by the City Council. 11. A Variance is granted to allow a free-standing price sign on the north side of the gas pumps. All other signage shall comply with the Ordinance standards, including the approved sign program. 12. The Site Plan shall be amended to indicate a ten foot separation between the sidewalk and the curb, along 34th Avenue North, consistent with the sidewalk plan for this area. 13. An easement for the 6 -ft. sidewalk and 10 -ft. setback from the curb along 34th Avenue shall be granted to the City. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the follow nq voted n favor thereof: or Schneider, Couneilmembers Vasiliou Ricker Zitur and Sisk The following voted against or abstained:. None Whereupon the Resolution was declared duly passed and adopted.
