HomeMy WebLinkAboutCity Council Resolution 1987-842CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meetinq of the City Council of the City of Plymouth, Minnesota, was held on the 14t day day of December , 1987. The following members were present: Mayor Schnei e3 r,-TouncIIme rs Va51110U, Zitur, Crain and Sisk The following members were absent: None Counciimember Sisk Introduced the following Resolution and moved its a opt on: RESOLUTION NO. 87-842 SETTING FORTH TERMS OF AGREEMENT BETWEEN JERRY FISCHER AND CITY OF PLYMOUTH WHEREAS, Mr. Jerry Fischer, 4630 Fernbrook Lane, has requested permission to connect to the City sanitary sewer adjacent to his property; and WHEREAS, Mr. Fischer has waived his rights with respect to a public hearinq on the levying of sanitary sewer area charges for said property; and WHEREAS, Mr. Fischer has agreed to convey to the City 40 feet of right-of-way for Fernbrook Lane adjacent to his property, including the easement for the extension of the sanitary sewer to his property; and WHEREAS, the City Manager in his report to the Council dated December 10, 1987, has further outlined considerations agreed to between the City and Mr. Fischer. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that in consideration of Mr. Fischer's conveying 40 feet of right-of-way for Fernbrook Lane, the City agrees that it will not assess to Mr. Fischer any additional public Improvement costs for the improvement of Fernbrook Lane adjacent to his parcel or other public utilities for a period of five years, or until his land is developed, whichever occurs first; BE IT FURTHER RESOLVED that the City will not undertake the rezoning of Mr. Fischer's property from its present FRD classification to any other land classification within the next five years unless Mr. Fischer's property is sold or he otherwise seeks said rezoning. The motion for adoption of the foregoing Resolution was duly seconded by Councileember Zitur , and upon vote being taken thereon, the followina voted In favor thereof: avor, chneider, Councilmembers Vasiliou, Zitur, Whereupon the Resolution was declared EN -,s y im
