Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 7th day of
December , 1987. The following members were present: ,
Mayor Schneider, Councilmembers Vasiliou, Zitur, Crain and Sisk
The following members were absent: None
Cminrilmemh.r Crain introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 87- 814
REQUEST FOR PAYMENT NO. 3 AND FINAL
DEEP WELL NO. 9 - PROJECT NO. 625
WHEREAS, the City of Plymouth as owner and Layne Western Company, Inc. as
contractor, have entered into an agreement for Deep Well No. 9, City Project
No. 625, said agreement being dated October 30, 1986; and
WHEREAS, the Engineer, Bonestroo, Rosene, Anderlik and Associates, Inc., has
certified his acceptance of the work and his approval of the final request for
payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $75,409.00, one change
order was approved deducting $1,400.00 and the value of the
work completed was $75,134.00.
2. That the work performed by the Contractor for Deep Well No.
9 and certified to the Council by the engineer as acceptable
be the same is hereby released from the contract except as
to the conditions of the performance bond, any and all legal
rights of the owner, required guarantees and correction of
faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of
$19,821.20 to Layne Western Company, Inc. for Deep Well No.
9 is hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Zitur,
Crain and Sisk
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
