HomeMy WebLinkAboutCity Council Resolution 1987-793CITY OF PLYMOUTH IDPursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 7th day of December . 1987. The following members were present: Mayor Schnei ed r Zo ncilmembersas aC u, Zitur, Crain and Sisk e following mem ers were absent: None Counclimember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-793 DENYING APPEAL BY JERRY BEHME OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING (9-2-87) WHEREAS, Jerry Behme, pursuant to Section 11, Subdivision C, of the Plymouth Zoning Ordinance, has appealed the September 8, 1987 ruling of the Board of Zoning Adjustments and Appeals relative to his request for a variance from the minimum front yard setback at 5700 Vagabond Lane North; and, WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter and the ruling was made to deny the variance; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjustments and Appeals as well as the petitioner's application for the variance; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the appeal by Jerry Behme and upholds the Board of Zoning Adjustments and Appeals ruling for the following reasons: 1. Granting the appeal would establish an undesirable precedent in the City. 2. Standards for a variance have not been met. 3. A barn could be constructed within the Ordinance required setbacks. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ziturand upon vote being taken thereon, the o lowing voted In favor t ereo a or Sc9nelder, Councilmembers Vasiliou Zitur, Crain and Sisk e following votea aga nst or abstained: None Whereupon the Resolution was declared duly passed and adopted.
