HomeMy WebLinkAboutCity Council Resolution 1987-701CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Co,incil of the City of Plymouth, Minnesuta was held on the 19th day of October 1987. The following members were present: Mayor Schneider, Councilmembers Vasiliou,, Zit nrs Crain and Sisk The following members were absent: _hone Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-701 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 762 STORM WATER POND BC -P12 COTTONWOOD PLAZA ADDITION WHEREAS, the City of Plymouth has undertaken Project No. 762, Storm Water Pond BC -P12, at the request of the developer of Cottonwood Plaza Addition; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council received a petition from Jerome Begin for the purchase of the necessary easements; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the City Attorney is hereby authorized to cowmence condemnation proceedings for Project No. 762 for the following described easement within the following described parcel: DESCRIPTION OF PARCEL: (P.I.N. 515-118-22-42-0006) khat part of t�Tie North 3/4 of the Northwest 1/4 of the Southeast 1/4 of Section 15 Township 118 Range 22, described as follows: Commencing at the Southwest corner of said North 3/4 of the Northwest 1/4 of the Southeast 1/4 of said Section 15, a distance of 324.65 feet; thence deflecting to the left at an angle of 123 degrees 57 minutes 30 seconds a distance of 185.63 feet; thence deflecting to the left at an angle of 40 degrees 28 minutes a distance of 71.8 feet; thence deflecting to the left at an angle of 52 degrees to the West line of the Northwest 1/4 of the Southeast 1/4 of said Section 15; thence South along said West line to the point of beginning; subject to an easement for a right of way over the West 16 5/10 feet thereof. Also, the North 1/4 of the Southwest 1/4 of the Southeast 1/4 of Section 15, Township 118, Range 22, and the South 1/4 of the Northwest 1/4 of the Southeast 1/4 of said Section 15, EXCEPT that part of the above described tracts described as follGws: Conmencing at the Southwest corner of the North quarter of the Southwest quarter of the Southeast quarter of said Section 15; thence North along the West line of Southeast quarter of said Section 15 a distance of 370.51 feet; thence Easterly at a deflection angle to the right 89 degrees 29 Minutes a distance of 706.5 feet; Resolution No. 87-701 Page Two r, thence South parallel with the West line of the Southeast quarter of said Section 15 to the South line of the North quarter of the Southwest quarter of Southeast quarter of said Section 15; thence West along said South line of the North quarter of the Southwest quarter of the Southeast quarter of said Section 15 to the point of beginning; subject to an easement for right of way over the West 16.5 feet thereof. DESCRIPTION OF EASEMENT: A permanent easement for drainage and ponding purposes over, under, across and through that part of the above described land. Said permanent easement described as follows: Commencing at the Southwest corner of the North 1/4 of the Southwest 1/4 of the Southeast 1/4 of said Section 15; thence northerly along the west line of the Southeast 1/4 of said Section 15 a distance of 370.51 feet: thence easterly deflecting to the right 89 degrees 29 minutes a distance of 706.50 feet to the point of beginning of the easement to be described; thence southerly parallel with the west line of said Southeast 1/4 to the south line of said North 1/4 of the Southwest 1/4 of the Southeast 1/4: thence easterly along said south line a distance of 360.00 feet; thence, northerly parallel with the east line of said North 1/4 of the Southwest 1/4 of the Southeast 1/4 a distance of 140.00 feet; thence; northwesterly deflecting to the left 36 degrees 49 minutes 11 seconds a distance of 225.00 feet; thence northeasterly deflecting to the right 90 degrees 00 minutes 00 seconds a distance of 90.00 feet; thence northwesterly deflecting to the left 90 degrees 00 minutes 00 seconds a distance of 70.00 feet; thense southwesterly deflecting to the left 90.00 degrees, 64.00 f feet; thence northwesterly to the point of intersection of the north line of the South 1/4 of the Northwest 1/4 of the Southeast 1/4 of said Section 15 and the center tine of Vinewood Lane as dedicated in the recorded plat of COTTONWOOD PLAZA; thence westerly along said north line 40.00 feet; southeasterly to the point of beginning. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the following voted in favor thereof: Haor Sceider. Councilmembers Vasiliou, Zitur, Crain and , Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted. h%,
