The following members were present: Mayor Schnei red , 7 o ncilmembersVaasillou; Zitur, Crain and Sisk'The— following he0 ow ng members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-674 DENYING PETITION TO ESTABLISH PUBLIC CARTWAY ACROSS OAKDALF WEST THIRD ADDITION (84097) WHEREAS, JoAnn Pribble, 17330 19th Avenue North, has petitioned the City to establish a public cartway over and across Oakdale West Third Addition located at 19th Avenue North and west of Dunkirk lane; and, WHEREAS, the petition and supporting materials have been reviewed by the City Attorney who finds that the City has neither the authority nor the duty to establish public cartways; and, WHEREAS, the petitioner has private driveway access to a public street via an established easement; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does deny the request to establish a public cartway across Oakdale West Third Addition based on the following reasons: 1. The City does not have the authority nor the duty to establish a public cartway. 2. The petitioner has private drive access to a public street, via an established easement. 3. Public access can be considered at such time that an application for plattinq the petitioner's land is submitted. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon,time f oTlow1nq voted In favor thereof: a or neider, Councilmembers Zitur, Crain and Sisk The o ow nq voted against or abstained: Counc mem er VasIllou Whereupon the Resolution was declared duly passed and adopted.
