The following members were present: Mayor Schne er, ouncilmembersas ou, Zitur, Crain and Sisk e following mem ers were absent: None Councilmember Zitur introduced the following Resolution and moved its ads;,. t ion: RESOLUTION NO. 87-672 APPROVING SITE PLAN AND VARIANCE FOR BEGIN DEVELOPMENT FOR BERKSHIRE OFFICE PARK (87098) WHEREAS, Begin Development has requested approval of a Site Plan and Variance to con- struct a 13,000 sq. ft. office building/bank facility at the northeast corner of County Road 9 and Berkshire Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Begin Development for a Site Plan and Variance for the construction of a 13,000 sq. ft. office building/bank facility at the northeast corner of County Road 9 and Berkshire Lane, subject to the following conditions: 1. Compliance with City Engineer's Memorandum except Item No. 28-F is deleted; and, Item 28-A is revised to provide that no building permit x_11 be issued until the expired Development Contract is revised. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for com- pletion of site improvements. 4. Any signage shall be in compliance with the Ordinance. 5. Any subsequent phases or expansions are subject to required reviews and arprovals per Ordinance provisions. 6. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 7. All waste and waste containers shall be stored within the enclosure and no outside storage is permitted. PLEASE SEE PAGE TWO Page two Resolution No. 87-672 1 8. An 8 1/2 x 11 Inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 9. Approval includes the following variances: a.) A 1 ft. versus 10 ft. setback for the drive aisle to the building to accommodate the drive-through for the bank. b.) A 10 ft. yard setback versus a 20 ft. yard setback from the front property line to the parking. c.) A 5 ft. yard setbd6 versus a 15 ft. yard setback from the side lot line to the drive aisle. The foregoing variances are granted because of the unique situation caused by the alignment problem of Berkshire Lane which is not the fault of the applicant. 10. The developer shall grant the City a 20 ft. street and utility easement along Berkshire Lane in -lieu of additional right-of-way dedication. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the o ow Tnq voted in favor thereof: Mayor nelder, Councilmembers Vasiliou Zitur, Crain and Sisk the o ow nq voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
