The following members were present: Mayor Schneiders ouuncllmembers Vasillou, Zitur 'and Sisk e following ers were a sent: CouncIlw&4mber Crain •N RRR Mayor Schneider Introduced the following Resolution and moved Its adoption: RESOLUTION NO. 87-587 APPROVING A CONDITIONAL USE PERMIT FOR RUDOLPH MARTI FOR 3 & R PIZZA, INC. (87089) WHEREAS, Rudolph Marti has requested a Conditional Use Permit to operate a pizza bakery and delivery service in the Cottonwood Plaza at the southeast corner of County Road 9 and Xenium Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, HE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Rudolph Marti, O 6 R Pizza, Inc. for a Conditional Use Permit to operate a pizza bakery and delivery service In the Cottonwood Plaza at the southeast corner of County Road 9 and Xenium Lane, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to Rudolph Marti for 0 & R Pizza, Inc. as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. Any signage shall conform with the City Ordinance standards. 5. There shall be no outside display, sales, or storage of merchandise or related materials. 6. The permit shall be renewed in one year to assure compliance with the conditions. 7. Compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance. 8. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 9. The Certificate of Occupancy is tied to the Development Contract for the Cotton- wood Plaza; and, that that Occupancy Permit will be withheld until the storm drainage or ponding area problem is resolved. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, t e o ownq voted In favor thereof: or SchHeider Councilmembers Vasiliou Zitur and Sisk eo ow nq voted against ora sta neWhereupon the Resolution was declared duly passed and adopted.
