HomeMy WebLinkAboutCity Council Resolution 1987-583CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 14th day of September , 1987. The following members were present: Mayor er Schnei d—,Zouncilmembers as ou, Zitur, Crain and Sisk The following mem ers were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-583 EXTENDING MORATORIUM ON THE DEVELOPMENT OF ADULT HALF -WAY HOUSES, COMMUNITY-BASED RESIDENTIAL FACILITIES, AND SIMILAR FACILITIES WHEREAS, the City Council under Resolution No. 86-758 authorized a study to determine how uses such as Adult Half -Way Houses, Community Correctional Facilities, Residential Facilities, and Community -Based Residential Facilities should be regulated within the City; and, WHEREAS, the City Council under the same Resolution set a moratorium on the development of those uses pending completion of the study and the adoption of any amendments to the City's Zoning Ordinance; and, WHEREAS, the moratorium period expires on November 25, 1987, and the moratorium period may be extended per State law for a period necessary to complete the study and adopt any necessary amendments to the City's Zoning Ordinance; and, WHEREAS, the study was conducted and has been completed by the consultant retained by the City; and, WHEREAS, the study has been received by the Planning Commission which is undertaking the review and consideration necessary to develop recommendations as to specific amend- ments to the City's Land Use regulations; and, WHEREAS, the Planning Commission has determined that the period of time necessary to complete the work will extend beyond November 25, 1987; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that the Council finds and determines the adoption of the following is neces- sary to protect the ongoing planning process in the City and to insure the health, safety, and welfare of the residents of the City of Plymouth: 1. The moratorium period established by Resolution No. 86-758 is hereby extended until May 25, 1989, or such earlier date as may be further adopted by a Resolution of the City Council. 2. The purpose of the extension is to provide the necessary time for the Planning Commission and City Council to complete the review of the study, and the adoption Of any necessary amendments to the City's Land Use regulations. No license, conditional use permit, or building permit may be Issued for such uses during the moratorium period, or may any rezonings, plattings, or replattings, or land divisions or consolidations be granted by the City for such uses during the moratorium period. 4. The moratorium shall not apply to any use that meets the definition of a Residential Facility as defined in Minnesota State statutes, Section 245.782, Subdivision 6, and which is regulated by Minnesota State statutes, Section 245.812, Subdivision 3 and 4, and Section 462.357, Subdivisions 7 and 8.
