Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 14th day of
September , 1987. The following members were present:
Mayor Schneider, Councilmembers Vasiliou. Zitur, Crain and Sisk
The following members were absent: None
Councilmember Crain introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 87-565
REQUEST FOR PAYMENT NO 4 AND FINAL
OLIVE LANE STREET AND UTILITY IMPROVEMENT PROJECT -
PROJECT NO. 542
WHEREAS, the City of Plymouth as owner and A.C.G., Inc. as contractor have
entered into an agreement for the Olive Lane Improvement Project, City Project
No. 542, said agreement being dated June 10, 1986 and
WHEREAS, the Engineer, Bonestroo, Rosene, Anderlik b Associates, Inc. has
certified his acceptance of the work and his approval of the final request for
payment:
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $99,412.90 and the value of
work completed was $100,484.28.
2. That the work performed by the contractor for the Olive Lane Street
and Utility Improvement Project and certified to the Council by the
engineer as acceptable be and the same is hereby released from the
contract except as to the conditions of the performance bond, any
and all legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 4 and Final in the amount of $12,374.55 to
A.C.G., Inc. for the Olive Lane Improvement Project is hereby
approved and the City Finance Director is hereby authorized and
directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Sisk , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou,
Zitur. Crain and Sisk
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
