Pursuant to due call and notice thereof, a special meeting of the City Council of the
City of Plymouth, Minnesota, was held on the 14th day of September , 1987. The

Councilmember Zitur introduced the following Resolution and moved Its
adoption:
RESOLUTION NO. 87-555
APPROVAL OF LAND USE GUIDE PLAN AMENDMENT FOR MARK 0. SENN, MARCUS DEVELOPMENT
CORPORATION (87066)
WHEREAS, Mark 0. Senn, Marcus Development Corporation has requested approval of reclas-
sification of Land Use Guiding for approximately 14.7 acres of LA -3 (high medium
density residential) designated land and approximately 1.62 acres of CS (service
business) designated land to CN (neighborhood shopping center), located in the north-
east quadrant of the intersection of State Highway 55 and West Medicine Lake Road; and,
WHEREAS, the Planning Commission has considered the request following a duly scheduled
public hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the reclassification of land use gilding
for Mark 0. Senn, Marcus Development Corporation, for approximately 16.32 acres of
which 14.7 acres is LA -3 (high medium density residential) and approximately 1.62 acres
Is CS (service business) to CN (neighborhood shopping center), located in the northeast
quadrant of the intersection of State Highway 55 and West Medicine Lake Road, subject
to the following conditions:
1- Compliance with the City Engineer's Memorandum.
2. Staging of the development shall be in accordance with utility availability as
approved by the City Engineer.
3. Draft restrictive covenants for the private ownership and maintenance of open areas
shall be submitted with preliminary plat/plan application, as well as a development
plan for the trails within this area.
4. The preliminary plat/plan shall identify specific areas of existing trees to be
preserved.
5. A Conditional Use Permit application for any anticipated Flood Plain modifications,
shall be submitted with the Preliminary Plat/Plan application. The information
shall respond to provisions of Section 6 of the Zoning Ordinance.
6. Park dedication requirements shall be satisfied with cash fees -in -lieu of land
dedication.

7. The petitioner shall enter into an agreement guaranteeinq the completion of the
Improvements specified in the dune, 1987 traffic study and the development shall
comply with this study.
S. Any future expansion proposal shall be subject to a traffic analysis to be prepared
by the City consultant, at the developers expense, to determine if any additional
development can be accommodated on the public road system.
9. Approval of the Land Use Guide Plan Amendment to reclassify the designation from
LA -3 (high medium density residential) and CS (service business) to CN (neighbor-
hood shopping center), is on the basis that the Comprehensive Plan Criteria are
satisfied as to this being the highest and best use of this land; any change in the
use or character of the proposed development of the proposed CN area will result in
reconsideration.
10. Approval of the Land Use Guide Plan Am-:!idment is contingent upon and subject to the
required review and response by the Metropolitan Council, and the Final Plan/Plat
which shall be approved by the City Council prior to finalization of the amendment.
11. The Development Contract shall be executed and the Building Permit shall be issued,
with all fees paid prior to September 1, 1988, or this Resolution will be void, and
the reguiding will not take place. Further, there shall be no extension of this
deadline.
12. This reguiding is conditioned upon the subsequent reguiding of the Larson Repair
and Towing parcel from CS (service business) to CN (neighborhood shopping center)
and the integration of that parcel to this development and the upgrading of the
Larson property. The upgrading shall be a part of the Development Contract for the
Marcus development or, subject of a separate Development Contract executed at the
same time.
13. The developer agrees to accept additional Special Assessments and Area Utility
Charges, now estimated at $150,000.00, which final sum shall be assessed to the
parcel upon approval of the Final Plat. This sum represents the difference between
the assessments and charges under the current LA -3 (high medium density residen-
tial) and CS (service business) land use classifications and the proposed CN
(neighborhood shopping center) guiding.
14. As per the petitioner's request, the "Wholesale Club" type use would not be
appropriate on this site, and the use will be a unified neighborhood shopping
center with an anchor retail tenant, consistent with the Comprehensive Plan and
with the submitted Concept Plan.
The motion for adoption of the foregoing Resolution was duly seconded by
