HomeMy WebLinkAboutCity Council Resolution 1987-540CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the day of August , 1987. The following members were present: Mayor Schneider�ouncilmembers asi iou, Zitur, Crain and Sisk The following mem ers were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-540 APPROVAL OF LAND USE GUIDE PLAN AMENDMENT AND PLANNED UNIT DEVELOPMENT CONCEPT PLAN FOR RYAN CONSTRUCTION COMPANY (87027) WHEREAS, Ryan Construction Company has requested approval of reclassification of Land Use Golding for approximately 14 acres located in the northwest quadrant of State Highway 55 and County Road 18, IP (planned industrial) to CS (service business); and, WHEREAS, Ryon Construction Company has requested approval of a Planned Unit Development Concept Plan for the 21.3 acre site adjacent to the Groves/I.T.T. Mixed Planned Unit Development (86-1) located to the east; and, WHEREAS, the Planning Commission has considered the request following a duly scheduled public hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the reclassification of land use guiding for Ryan Construction Company of approximately 14 acres from IP (planned Industrial) to CS (service business) and of approximately 7.3 acres from IP (planned industrial) to CL (limited business) in the northwest quadrant of County Road 18 and State Highway 55; the PUD status With size waiver; and, a Mixed Planned Unit Development Concept Plan which Is adjacent to the Groves/I.T.T. MPUD (86-1), based on the following findings; and conditions: 1. Compliance with the City Engineer's Memorandum. 2. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 3. Drdit restrictive covenants for the private ownership and maintenance of open areas shall be submitted with preliminary plat/plan application, as well as a development plan for the trails within this area. 4. The preliminary plat/plan shall identify specific areas of existing trees to be preserved. 5. A Conditional Use Permit application for any anticipated Flood Plain encroachment and/or modifications, shall be submitted with the Preliminary Plat/Plan application. The information shall respond to provisions of Section 6 of the Zoning Ordinance. PLEASE SEE PAGE TWO Page two Resolution No. 87-540 6. Approval of the Land Use Guide Plan Amendment is contingent upon, and subject to the required review and response by the Metropolitan Council, and the Final Plat/Plan based upon the MPUD Concept Plan and Preliminary Plat Plan, all of which shall be approved by the City Council prior to finalization of the Amendment. 7. Road and traffic improvements, including dedication of right-of-way and construction shall be consistent with City Plans and Codes. These shall be identified and resolved with the preliminary plan/plat. 8. The petitioner shall enter into an agreement guaranteeing the completion of the improvements specified in the April, 1987 traffic study; development shall comply with this study. 9. Applicable conditions and requirements relative to the MPUD 86-1 shall carry forward to the revised MPUD. 10. Applicable requirements of State Fnvironmental Assessment and Pollution Control Regulations shall be addressed with submittal of the preliminary plat. 11. The CS (service business) and the CL (limited business) classifications are consistent with the Comprehensive Plan criteria for this site and represents the highest and best use of the land as part of the "gateway" Planned Unit Development. 12. The PUD Plan shall provide that the CL classified area shall be developed with "high tech" office/service buildings of high aesthetic quality and of high level site amenities; and, the commercially available storage within the buildings shall he less than 25% of the total floor area. 13. The Development Contract shall be executed, the Final Plat shall be recorded, and the initial building permit shall be issued, with all fees paid, prior to September 1, 1988, or this Resolution and approval of the requiding will be void and the reguiding will not be implemented. There shall be no extension of the deadline.
