HomeMy WebLinkAboutCity Council Resolution 1987-494CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 27th day of July , 1987. The following members were present: Mayor Schneider, Councilmembers Crain, Zitur, _ Vasiliou and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-494 APPROVING PRELIMINARY PLAT AND VARIANCE FOR DENNIS BACKES, NORTHWOOD HOMES, INC. FOR PONDS NORTH (87058) WHEREAS, Dennis Backes, Northwood Homes, Inc., has requested approval for a Preliminary Plat and Variance for Ponds North for 128 multi -residential dwelling units on approximately 30 acres located at 54th Avenue North and Nathan Lane: and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat and Variance for Dennis Backes, Northwood Homes, Inc. for Ponds North, a multi -family residential development located at 54th Avenue North and Nathan Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water and the PCA permit has been issued. 4. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage according to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County, based upon the approved site plan(s) for this development. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. The required application for conditional use and site plan approval shall be submitted prior to or concurrent with the Final Plat. 8. Rezoning shall be finalized with filing of the Final Plat. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 10 No yard setback variances are granted or implied. 11. Private drive access shall be limited to internal public roads and restricted from Nathan Lane. 12. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. 13. The variance for the proposed Lot 1, Block 3 is approved on the explicit condition that consolidation with adjacent land will be accomplished concurrent with the final plat; it is based upon the understanding that the consolidation proposal has been approved by the adjacent owner; if this cannot be accomplished, the preliminary plat shall be subject to reconsideration. 14. More detailed information shall be provided by the Parks and Recreation Department regarding the design of park access trail corridors with submittal of the Site Plan, Conditional Use Permit, and Final Plat applications. The motion for adoption of the foregoing Resolution was duly seconded by and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider. Councilmembers an he following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
