HomeMy WebLinkAboutCity Council Resolution 1987-389CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 15th day of June , 19M. The followl,nj members were present: Mayor Schneider. Councilmemberc Crain_ Sisk, _ Zitur and Vasiliou The following members were absent: none Councilmemb& Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 87- 389 APPROVING MIXED PLANNED UNIT DEVELOPMENT CONCEPT PLAN FOR DAVID PETERSON, HEW-LYN, INC./FCG DEVELOPMENT (87007) WHEREAS, David Peterson, Hew -Lyn, Inc./FCG Development has requested approval of a Mixed Planned Unit Development Concept Plan for the development of 84 single family residential lots; 46 townhome lots; and, 158 multi -family residential units on 53.3 acres; and, 10 acres for neighborhood shopping and public park, on property located one-quarter mile east of Zachary Lane, south of County Road 10; and, WHEREAS, the Planning Commission has reviewed the request at duly called Public Informational Hearings and has recommended approval; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Mixed Planned Unit Development Concept Plan for David Peterson, Hew -Lyn, Inc./FCC Development for a development to be known as "Harrison Hills Ponds" consisting of 84 single family residential lots; 46 townhome lots; 158 multi -family residential snits; and, 10 acres for neighborhood shop- ping and public park located one-quarter mile east of Zachary Lane, south of County Road 18, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Staging of the development shall he in accordance with utility availability as approved by the City Fngineer. 3. Maximum density shall be 3.6 units per acre and 6.5 units per acre for the LA2 and LA -3 land, respectively, for land which is at or above the established high water elevation per the adopted City Storm Water Drainage Plan, as verified by the City Engineer. Three density bonus points are assigned as follows: a) Project size +1 b) Variety of Housing +1 c) Private Open Space +1 4. The preliminary plat/plan application shall include detailed explanation of any requests for reduced side yard setbacks; and, for lot coverage greater than 20%. No such lot size or coverage variances are granted or implied. PLEASE SEE PAGE TWO Page two ' Resolution No. 87- 389 5. Draft restrictive covenants and homeowner association by-laws for the private open areas shall be submitted with preliminary plat/plan application. A sign with a map showing all approved lots and public and private amenities shall be displayed at all entrances to the subdivision so all prospective buyers know their location. 6. A temporary construction access shall be provided at the Intersection of the new north/south street and County Road 10 for all construction vehicles until the first house is certified for occupancy. This is to include positive blocking of 55th and 56th Avenues with a fence. 7. The preliminary plat/plan application shall address the applicable Flood Plain and Shoreland Management Ordinance standards. S. No private drive access shall he permitted to County Road 10; all private access shall be provided from internal public streets. 9. The PUD plan shall address the ordinance residential transition standards. 10. The City and the petitioner shall work with Hennepin County and Tennant Company to discuss and determine the access to and intersections with County Road 10, during the review of the preliminary plat. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur, and upon vote being taken thereon, the following voted in favor thereof: Mayor c Heider, Councilmember Crain, Sisk, Zitur and Vasiliou The following voted against or abstained: none hereupon the Resolution was declared duly passed and adopted.
