HomeMy WebLinkAboutCity Council Resolution 1987-387CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 15th day of June , 1987. The following members were present: Ma or Schneider, Councilmembers Crain, Sisk, Zitur and Vasiliou The following members were absent: none Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 87- 387 AUTHORIZING THE VACATION OF CERTAIN STREET AND DRAINAGE EASEMENTS FOX RUN 2ND ADDITION WHEREAS, a petition was received to vacate certain street and drainage easements in the Fox Run 2nd Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for June 15, 1987 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of June 15, 1987; and WHEREAS, the Council did hold a public hearing on June 15, 1987 to inform any and all interested parties relevant to the vacation of certain easements in the Fox Run 2nd Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following street and drainage easements be vacated: A temporary easement for storm water ponding purposes over and across that part of Outlot A, Fox Run 2nd Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles, described as follows: Beginning at the Southeast corner of said Outlot A; thence Northerly along the East line of said Outlot A, 80.00 feet; thence Westerly to the most Easterly corner of Lot 1, Block 1 of said Fox Run 2nd Addition; thence Southeasterly along the Southwesterly lines of said Outlot A, to the point of beginning. A temporary easement for street right-of-way purposes over, under and across that part of Outlot A, Fox Run 2nd Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles, which lies within the circumference of a circle having a radius of 50.00 feet. The center of said circle is a point on the Northeasterly extension of the centerline of Yuma Lane as platted in said Fox Run 2nd Addition, distant 43.30 feet Northeasterly of the Northeasterly end of said Yuma Lane. Resolution 87- 387 Page Two A temporary easement for street right-of-way purposes over, under and across that part of Lot 1, Block 3, Fox Run 2nd Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles, which lies within the circumference of a circle having a radius of 40.00 feet. The center of said circle is the intersection of a line 15.00 feet Northeasterly of and parallel with the Northeasterly line of said Lot 1 and a line 35.00 feet Northwesterly of and parallel with the Southeasterly line of said Loe 1 and its Easterly extension. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmember Crain, Sisk, Zitur and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
