Pursuant to due call and notice thereof, a regular meeting of the City Council of the
City of Plymouth, Minnesota, was held on the 20th day of April , 1987. The
following members were present: Mayor Schneider, Councilmembers Crain, Vasiliou, Zitur,
and Sisk The
following members were absent:
Councilmember Sisk introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 87-247
APPROVING PRELIMINARY PLAT AND VARIANCES FOR BONESTROO, ROSENE AND ANDERLIK &
ASSOCIATES FOR THE CITY OF PLYMOUTH (87013)
WHEREAS, Bonestroo, Rosene and Anderlik & Associates has requested approval for Rezon-
ing, Preliminary Plat and Variances for the City of Plymouth to plat approximately 42
112 acres to create separate lots fur a municipal water treatment plan, right-of-way
for County Road 9, and City parkland; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear-
ing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the Preliminary Plat and Variances for
Bonestroo, Rosene and Anderlik & Associates for the City of Plymouth for property
located west of Zachary Lane in tsne vicinity of, and including Zachary Lane Park; north
of County Road 9, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of issuance of Building Permit.
3. Provisions for a 30 ft. wide trail easement per Comprehensive Park Plan, as veri-
fied by the Parks and Engineering Departments, with submittal of detailed plans as
to construction of the trail per City standards.
4. Rezoning shall be finalized with filing of the Final Plat.
5. The Final Plat shall be filed and recorded with Hennepin County within 60 days of
the City acquiring title to the Forster property as included within the Prelimin-
ary Plan.
6. No yard setback variances are granted or implied.
9. Approved variances are lot width of 92 ft. and lot size of 17,250 sq. ft. for Lot
3, Block 1.
10. Access shall be limited to internal public roads and restricted from County Road
9.

11. Appropriate legal documents covenants and restrictions as approved by the City
Attorney, shall be filed with the Final Plat establishing that Lot 3, Block 1
shall be consolidated with land to the west.
12. Appropriate legal documents allowing for shared drive access for Zachary Lane Park
and Lot 1, Block 2, as approved by the City Attorney, shall be filed with the
Final Plat.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the following
voted in favor thereof: 5 Ayes
The following
voted against or abstained: None Whereupon the
Resolution was declared duly passed and adopted.
