CITY OF PLVMDM
Pursuant to due call and notice thereof, a regular meeting of the City Council of the
City of Plymouth, Minnesota, was held on the 6th day of April , 19 87. The
following members were present: Mayor Schneider, Councilmembers Crain an isk — _
The
OP following members were absent: Councilmembers VdS7 lou and Zitur
Councilmember Crain introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 87- 227
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR JOHN
KAROS FOR HERITAGE WEST 2ND ADDITION (RPUD 84-4) (86048)
WHEREAS, the City Council has approved the Final Plat and Development Contract for
Heritage West 2nd Addition as requested by Sohn Karos;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CIT1 OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with City
Policy in effect at the time of filing the Final Plat.
3. No Building Permits shall be issued until a Contract has been awarded for the con-
struction of municipal sewer and water.
4. Removal of all dead or dying trees from the property at the owner's expense.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
6. No yard setback variances are granted or implied.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
S. No Building Permits to be issued until the Final Plat is filed and recorded with
Hennepin County.
9. Appropriate legal documents regarding Homeowner Association covenants and restric-
tions as approved by the City Attorney, shall be filed with the Final Plat.
10. The Final Plat mylars shall contain a staement noting that the plat is part of the
approved RPUD 84-4 per Section 9 of the Zoning Ordinance.
11. Access shall be limited to internal public roads and restricted from Xenium Lane.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Sisk , and upon vote being taken thereon, the following
voted in favor thereof: Mayor c–Fneider, Councilmembers Crain and Sisk
The following
voted against or abstained: none Whereupon the
Resolution was declared duly passed and adopted.
