Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 16th day
of March, 1987. The following members were presen�ay0r
Schneider. Councilmembers Crain, Sisk, Vasiliou and Zitur
The following members were absent: none
Councilmember Crain introduced the following Resolution and moved
its adoption:
RESOLUTION N0. 87- 175
AUTHORIZING THE VACATION OF
PONDING AND DRAINAGE EASEMENT
GROVES OFFICE PARK ADDITION, OUTLOT "A"
WHEREAS, a petition was received to vacate a certain ponding and drainage
easement in Groves Office Park Addition, Outlot "A"; and
WHEREAS, a public hearing with respect to said vacation was scheduled for March
16, 1987 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of March 16, 1987; and
WHEREAS, the Council did hold a public hearing on March 16, 1987 to inform any
and all interested parties relevant to the vacation of said easement; and
WHERLAS, it was determined by the City Council that said easement was not
needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, htNNESOTA that the following ponding and drainage easement be
vacated:
That part of Outlot A, Groves Office Park, according to the plat on
file and of record in the office of the Registrar of Titles,
Hennepin County, Minnesota, described as follows: Beginning at the
Northeast corner of said Outlot A; thence North 89°-57'-23" West,
assumed bearing, along the North line of said Outlot A, a distance
of 60.00 feet; thence South 28°-03'-13" West, a distance of 103.71
feet; thence South 760-53'-12" West, a distance of 163.78 feet;
thence South 0°-46'-27" East, a distance of 180.00 feet; thence
North 89°-13'-33" East, a distance of 150.31 feet to the
Northwesterly right-of-way line of 9th Avenue North; thence
Northeasterly, along said right-of-way line, a distance of 59.68
feet; thence North 00-46'-27" West, a distance of 133.35 feet;
thence North 61°-28'-02" East, a distance of 107.36 feet to the
East line of said Outlot A; thence North, along said East line, a
distance of 70.00 feet to the point of beginning.
AND, FURTHER BE IT RESOLVED, that said easement should not be vacated
until the City is furnished with a drainage easement for a ditch through
Outlot "A" to accomodate the drainage as directed by the City Engineer.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Crain,
Sisk. Vasiliou and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
